Common sense question here.
Why has an immigration judge not always had to power to immediately reject or deport or detain any persons caught attempting to cross the border without going through proper immigration stations?

Common sense solution to illegal immigration here.
Any person caught by ANY law enforcement officer and suspected of being an illegal immigrant be held until proven to be a citizen or legally within the US border. Thus making it too personally costly to illegally enter the US!
