US Supreme Court Strikes Down Racial Gerrymandering

In a 6-3 ruling today, the Supreme Court struck down Louisiana’s congressional map (SB8) as an unconstitutional racial gerrymander. Justice Alito wrote the majority opinion, holding that race predominated in drawing a second majority-Black district.

The Court ruled that compliance with Section 2 of the Voting Rights Act does not provide a compelling interest to justify race-based districting, narrowing the VRA’s application and updating the Gingles framework. Thomas concurred; Kagan dissented.
