BREAKING NEWS: Killearn Country Club Issue Makes it on Court Calender

The issue surrounding the redevelopment plan proposed by the the owner of the Killearn Country Club has finally reached the desk of a judge.

Claire Duchemin, who filed a lawsuit in circuit court claiming that Mr. Tuck must offer to sell the club to members before closing any part of the golf course, recently filed a motion for injunctive relief.

The motion, which can be read here, asks the court to prohibit the owner of the club from conducting any type of vote of members to circumvent or violate the special covenant providing the membership with the member purchase right until this controversy is resolved.

The motion is in response to a vote of the membership that the owner of club has scheduled for December 18th.

Circuit Judge James Hankinson will hear the motion on December 17, 2014 at 9:00. The motion granting the hearing can be read here.

  1. Excellent motion – glad to see someone is taking action on this matter. It seems like the HOA should be taking some action to protect the homeowners along this part of the course as well.
