The District Court of Appeal Overrules Judge Dodson for the Second Time

The controversy surrounding the residency of City Commissioner Scott Maddox is beginning to resemble a tennis match between Judge Charles Dodson and the First District Court of Appeal (DCA).

Today the First DCA overruled Judge Dodson’s most recent decision, which held that Scott Maddox resided within the boundaries of the City of Tallahassee.

This is the second time the First DCA has reversed a decision made by Judge Dodson in this case.

In the most recent First DCA reversal, which was based on an appeal by Dr Erwin Jackson, the court stated “we vacate the trial court’s final order in its entirety and remand for further proceedings in accordance with section 102.168, the Rules of Civil Procedure, and due process.”

The First DCA said that Judge Dodson’s court “abused its discretion by proceeding to hear the merits of Appellant’s election contest without proper notice to the parties that the hearing would proceed as a final evidentiary hearing, without resolving Appellant’s pending discovery requests, and without ruling on a number of unresolved motions.”

The First DCA added that Dodson’s court “erroneously concluded that discovery was not available.”

The First DCA order means that Dr. Jackson will be afforded a full hearing with discovery rights. However, the first issue to be addressed in court will be a request by Dr. Jackson to disqualify Judge Dodson from the case.

Dr. Jackson filed a motion for Dodson’s disqualification based on several factors which include open hostility shown by the trial judge to the plaintiff and the plaintiff’s counsel.

  1. Judge Dodson, in a recent case involving cyber defamation, incarcerated a person for violating Injunction. The Injunction contains full of unclear and ambiguous statements. Idiot Dodson does not know anything about computer science but he pretended as if he is an expert in computers. Idiot Dodson is very arrogant and is head strong. Idiot Dodson must be removed as judge from any court.

  2. Who investigates judges that rule in favor of their friends? Somebody should find out if judge Dodson and Commissioner Maddox are friends, or if his ruling was just another in a long line of sloppy judging with minimal attention to the law.

  4. The DCA should over rule him a third time by reversing his decision to deny the Motion for Recusal. He cannot preside over this case in an unbiased manner. The appearance of impropriety is clear.

  5. Judge Dodson has a reputation, with local attorneys, of paying little attention to the details of the law. This poses a significant problem. I suggest some outreach to Chief Circuit Court Judge Jonathan Sjostrom followed by public complaints with the Florida Supreme Court. There are some fine, honorable Judges on the 2nd Circuit, but Dodson’s actions cast doubt on the entire system and bring credible concern for fairness inside our county courts. It should not be a roll of the dice to have a fair and legal proceeding in court.   6. This judge, really? Pretty sad display of Tallahassee plantation snobbery, straight from the bench. I’m thankful Dr. Jackson has recourse outside of this clown’s courtroom .
