Leon County Could Receive Opioid Litigation Settlement Funds by May

On February 8, 2022, Leon County Commissioners agreed to move forward with signing and submitting a participation agreement for the opioid litigation settlement involving Endo Health Solutions, Inc. and Endo Pharmaceuticals, Inc. settlement proposal.

In June 2018, Leon County entered into a contract with outside counsel, Levin, Papantonio, P.A., and Parks Law, LLC, to represent the county in multidistrict opioid litigation against opioid manufacturers, distributors, and retailers.

The Florida’s Office of the Attorney General began holding meetings with Florida local municipalities to negotiate a unified plan for allocating and using the opioid settlement proceeds. The Memorandum of Understanding with the Florida (MOU) provided the framework for the Unified Florida Plan and was adopted by the Board in September 2021.

The Leon County Commission has considered and approved several proposed multidistrict legal proceedings. These proceedings include a bankruptcy plan by Purdue which should have concluded on February 1, 2022, the Mallinckrodt Pharmaceuticals bankruptcy plan, and one with three distributor defendants, AmerisourceBergen, Cardinal Health, and McKesson, which is set to conclude on February 25, 2022.

Most recently, outside counsel has notified the Leon County that Endo Health Solutions, Inc. and Endo Pharmaceuticals, Inc., are ready to settle litigation in Florida. The proposed settlement in Florida is a lump-sum payment of $65 million. Of the $65 million, roughly $55 million will be available for restitution, and $10 million will compensate the lawyers who represent the state and local municipalities.

Local governments must submit Subdivision Settlement Participation Agreements (Participation Agreements) within 30 days. Based on the previously adopted Unified Florida Plan, 15% of the remediation funds will be paid directly to the participating local governments. If sufficient participation occurs within the 30-day deadline, subdivisions should receive their designated payment around April or May of 2022.

Hell it’s because of US that ea state was able to sue all these companies, majority we are excluded from although our hippa rights were violated…we are literally being used so the states can collect money. How do 3 huge pharmacies not report our prescriptions for over a decade and FL already sued, got paid, and we were left out of it. I was raped, I never did drugs, I didn’t ask for any of this, but the states sure are benefiting off our pain and trauma. I never even knew what withdrawals were until I went stop taking &next thing I know I’m suicidal. We have to prove our case but we can’t cuz the pharmacies don’t have records, Drs don’t, so FL Attorney Moody made sure to sue those pharmacies to benefit FLORIDA BUT NOT THE PEOPLE HARMED BY THIS BS!

  2. That $ has already been promised to FSU for their football stadium because $27 million is not going to cover the leather seating promised to Golden Chiefs and above.
